Ebaums World Stole My Video

Ebaums World Stole My Video !!
So a while ago I made this metacafe video to go along with my instructable and ebaums world took it and uploaded it to their site without asking me or giving me any credit. Here is a link to the page on their site where they uploaded it. At the bottom of their page it says to email the webmaster if you are the author and you would like it removed but they don't list the webmasters email address. This is crazy. Makes me so mad! So I emailed there legal team this message.

To whom it may concern,

I created this metacafe video and it was uploaded onto your site here. I would like you to remove it from your site, give me some ad revenue or in worst case scenario I will have to take legal action against you. I would not like to take legal action against you but I feel that it is not right for you to steal my content without permission. If I don't receive a proper response in 4 business days I will take this story to the public.

What should I do now? I want them to remove it but they won't. I am wondering what the community here thinks?

 I think you are wasting your time, ebaumsworld didn't steal your video it is sharing your video with other people, do you download free music? well you probably owe 1000's of dollars to many record labels, stop your crying, and just move on with your life. Your video is not special and is worth a dollar if anything.

Please be advised that the video entitled "Rock Lobster Prank", and hosted on your site at http://www.ebaumsworld.com/video/watch/277696/ is an illicit copy of a video originally posted to the Metacafe website and intended for embedding within the site http://www.instructables.com

Your site is hosting it without permission, and the addition of the "eBaum's World" identifier in the corner incorrectly implies that the copyright to the material is owned by eBaum's World.

My client requires that you:

1. Compensate him for lost revenue, at a level comparable or in excess to that possible with similar viewing-levels through the Metacafe and Instructables websites.
2. Remove the video from public availability on the eBaum website and all affiliated or associated websites.
3. Delete the video from all computers (including, but not limited to, servers, desktops, laptops, mobile communication devices and PDAs) within the direct or indirect control of eBaum, its employees and its representatives (including copies uploaded, emailed or otherwise transferred to other computers (as previously defined)

There is no deadline on these requests. Action is expected to be taken immediately. Please note that the matter will not be considered "closed" or "satisfied" until I have received such instruction from my client.

This is just like when people repost videos on YouTube. The information is part of some sort of odd type of media classification. I want to say it's called "Free _____" Something like that. Anyway, it's legal to repost if it's not copyrighted I think. I dunno, I still hate Ebaumsworld though.

Great job and I agree that misappropriating IP is a bad thing, but I have a hard time feeling sorry for you when your Rock Lobster clip goes way beyond fair use, specifically, "amount and substantiality of portion used." If you did get permission to use the clip, please ignore everything after the comma in the first sentence.

I didn't get permission. Good point. I guess there so many different videos on the internet with this song already I didn't even think about it but it does not make it correct. But I am still kind of pissed that they jacked my video :( Thanks Joe

If possible, also try recording it, so you have evidence that it hasn't been edited. Try using the trial version of Camtasia Studio. Its right here

Your not the first or the last one. 1) Take snapshots of the page 2) Get some help, you can easily sue. Be careful though, these guys can get ugly. Albinoblacksheep.com (a flash website) has gotten into numerous fights because Ebaums world stole vids from there. A popular case was of a kid called Allan or something that made an awesome animation called "Animator vs. Animation." Things got really ugly and they tricked him (13) with legal loopholes. Albinoblacksheep members may help u a bit there. 3) Get legal help like a lawyer or attorney immediately! You have to act fast. Again, be very careful, these guys receive these all the time, they know how to take you down.

Oh thanks for all of tips. I justed used Tipcam to record a screen video of it on there site. Do you think I should download there version of my video also? Thanks I have couple of other vidoe capture programs but my favorite is tipcam because has a zoom function and it is free. I also have CamStudio which is free. Thanks again man!
