NO PURCHASE NECESSARY TO ENTER OR WIN. Entry into this Contest constitutes your acceptance of these Official Rules.

CONTEST ENTRY DATES: The CRAFTSMAN Workshop of the Future Contest (the Contest) begins at 12:01 AM Pacific Standard Time (PST) on 12/2/08 and ends at 11:59 PM PST on 1/4/09 (Entry Period).

WHO MAY ENTER: Contest is open to: (i) legal residents of the 50 United States and the District of Columbia and Canada (except the province of Quebec); and (ii) age 18 or older at time of entry. Employees and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside or those living in the same households, whether or not related) of Popular Science Media Group (the Sponsor and herein referred as Popular Science), Sears Holdings Corporation (Sears), Instructables.com and their respective parent companies, affiliates, subsidiaries, retailers, dealers, advertising and promotion agencies (collectively, Contest Parties) are not eligible to enter or win. Contest governed by U.S. law. Contest is subject to all applicable federal, state, province and local laws and regulations. Void in Quebec and where prohibited by law.

OBJECTIVE: The objective of this Contest is to engage users to post a project that uses CRAFTSMAN tool(s) or other brands of tool(s) to create a project. The contestant is encouraged to explain what tool(s) is/are used to create the project. You can submit as many entries as you wish as long as each entry is submitted independently.

HOW TO ENTER: During the Contest Entry Period, visit www.instructables.com (referred herein as website), and follow the onscreen instructions to complete the registration process, including documenting your project in English in a step-by-step process as indicated on the website (Entry). All Entries must be received by 11:59 p.m. PST on 1/4/09 to be eligible for the Contest. Receipt of an Entry occurs when www.instructables.com's servers record the Entry information resulting from user clicking the "Submit" button. Entry can be in full Instructable, video or slideshow format. Only projects that are relevant to the objective of the Contest will be posted on website and will advance to Round One of the Contest.

ENTRY CONTENT GUIDELINES
Entries that do not meet the following Content Guidelines are subject to disqualification from Contest consideration and/or removal, in the Sponsor's sole discretion:
" Entries must comply with the Terms of Use posted on website and these Contest Official Rules.
" Entries must be the original work of the contestant, and may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Entry contains any material or elements that are not owned by the contestant and/or which are subject to the rights of third parties, the contestant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules (collectively, the Clearances). By submitting an Entry, contestant warrants and represents that he or she has all rights to the Entry.
" Entries must not include material that (i) are sexually explicit, indecent, obscene, unnecessarily violent, hateful, tortuous, defamatory, slanderous or libelous, (ii) is derogatory, designed to harass or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (iii) invades the privacy or publicity rights of any person, living or deceased, or the intellectual property or other rights of any person or entity, (iv) is unlawful, (v) is disparaging to any of the Contest Parties or is inconsistent with the positive images and/or goodwill such parties have worked hard to create and wish to associate with their companies.

Contestants grant the Sponsor the right to post Entries on its website and are available to be viewed by anyone with access to the Internet. The Contest Parties shall have no liability for the use or misuse of your Entries by third parties. All Entries may remain on such website in perpetuity or for as long as Sponsor deems appropriate to archive.

Your Entry may not be acknowledged and will not be received or held in confidence and your Entry does not create a confidential relationship or obligation of secrecy between you and the Sponsor or its respective parent companies, affiliates or subsidiaries. Entries will not be returned or acknowledged.

CONTEST JUDGING: There are three rounds of judging.

Round One: All eligible Entries will be open for public voting between 12:01 AM PST on 1/5/09 and 11:59 PM PST on 1/11/09. Registered users of www.instructables.com can vote for all Contest Entries. Limit one vote per user per Entry. The top 30 Entries with the most votes will advance to Round Two.

Round Two: The 30 top scoring Round One entries will be judged during business hours by a panel of judges from Popular Science between 1/12/09 and 1/18/09 to determine the top scoring 15 entries based on the following equally weighted judging criteria (25% each): 1) creativity; 2) originality; 3) relevance to topics; and 4) clarity of Instructable/slideshow/video and the description. In the event of a tie in Round One, entries will be determined based on highest score for creativity. In the event of a further tie, entries will be determined based on highest score for originality. The top scoring 15 entries will advance to Round Three.

Round Three: The 15 top scoring Round Two entries will be re-judged during business hours by a panel of judges from Sears between 1/19/09 and 1/25/09 based on the following equally weighted judging criteria (25% each): 1) creativity; 2) originality; 3) relevance to topics; and 4) clarity of Instructable/slideshow/video and the description. In the event of a tie in Round Three, entries will be determined based on highest score for creativity. In the event of a further tie, entries will be determined based on highest score for originality.

At the end of Round Three judging, the Entry with the highest score, as determined by the judges in their sole discretion, will be declared the Grand Prize winner. The second through eleventh highest scored entries will be declared the Runner-up prize winners. All other entries will not win a prize. All winners will be determined on or about 1/28/09.

If Grand Prize winner is disqualified for any reason, at Sponsor's discretion, the contestant with the next highest score may be declared the alternate Grand Prize winner. Sponsor reserves the right to not award the Grand Prize if, in their sole and absolute discretion, it does not receive a sufficient number of qualified Entries. Judges and Sponsors decisions are final and binding on all matters.

PRIZES: One Grand Prize: $20,000 worth of Sears CRAFTSMAN products (Approximate Retail Value (ARV): $20,000.00). Ten Runner-up Prizes: $500 worth of Sears CRAFTSMAN products (ARV: $500.00 each). All prizes will be awarded as Sears gift card(s). Usage of gift card is subject to Sears gift card terms and conditions. Total ARV of all prizes: $25,000.00.

PRIZE NOTIFICATION: All winners will be notified by email and may be required to execute and return an Affidavit of Eligibility and Liability and Publicity Release (Affidavit/Release) as well as any other documents which may be required by Sponsor, all of which must be received fully-executed within 10 days of date printed on notification or he/she may be disqualified. If a potential winner does not respond to the winner notification email (email will be sent three (3) times over a ten (10) day period), or if said email is returned as undeliverable, or if an entrant is otherwise found to be ineligible, or if the selected winner cannot accept or receive the prize for any reason, the potential winner will forfeit the prize and an alternate winner with the next highest score will be selected. A background check may be conducted on Grand Prize winner. Should winner makes any false statement(s) in any document required by Sponsor, s/he will be disqualified and required to promptly return to Sponsor his/her prize. Prizes are non-transferable. All taxes associated with any prize are the sole responsibility of the each winner.

Winning constitutes permission (except where prohibited by law) for Sponsor, Sears and Craftsman.com to use Grand Prize winner's or Runner-up's name, photograph and/or video, hometown, likeness, and prize won for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission.

GENERAL: Contest Parties and their respective officers, directors, agents, representatives and employees (collectively, Released Parties) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed Entries; all of which will be void. Released Parties are also not responsible for problems uploading or downloading any Contest-related information or materials from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Entry to be received by www.instructables.com on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a contestant's ability to participate in this Contest. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Contest, the processing of Entries, the announcement of prizes or in any Contest-related materials. Mass Entries or Entries generated by a script, macro or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness (e.g., Rick rolling), integrity or proper play of the Contest and, if terminated, at Sponsors discretion, determine the Grand Prize winner and Runner-up using all non-suspect, eligible Entries received up to time of cancellation. Authorized user is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the Entry process or the operation of this Contest or website, intending to annoy, abuse, threaten or harass any other contestant, Sponsor or any of its representatives or to otherwise be acting in violation of these Official Rules and void all associated Entries. CAUTION: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operations of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such contestant to the fullest extent permitted by law and to disqualify such contestant from the Contest.

SUSPENSION / MODIFICATION / TERMINATION: In the event the Sponsor is prevented from continuing with the Contest by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or provincial or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within its control (each a Force Majeure event or occurrence), Sponsor shall have the right to suspend or terminate the Contest. Sponsor reserves the right to suspend or terminate the Contest without notice or by posting a notice on website, in its sole and absolute discretion, if it is determined that the Contest is technically impaired or corrupted or fraud or technical problems, failures or malfunctions or any Force Majeure event(s) has destroyed or severely undermined or impaired the integrity and/or feasibility of the Contest.

RELEASES / INDEMNITIES: By entering the Contest, contestants agree to release and hold harmless the Released Parties from any and all third party claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Contest, or acceptance or use of any prize, the administration of the Contest, the operation of the website, the Released Parties use of any of the rights granted herein or any breach by contestant of any representation, warranty or covenant made by such contestant in connection with the Entry.

PRIVACY: Information collected from contestant is subject to www.instructables.coms privacy policy.

ARBITRATION AND CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this Contest, contestant agrees that (i) any and all disputes and causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the contestant; (ii) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (iii) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will contestant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and contestant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.

I submitted a coffee table design to this contest, I got an email confirming that it was accepted, but it hasn't shown up yet among the entries... is this just an end-of-year-everybody's-on-vacation kind of thing or is it a more meaningful computer glitch?

Why does Quebec is the only place in canada where I can't receive my prize?

It's a legal issue. We have nothing against Quebec.
Instructables should take some action to allow Quebec residents to enter Instructable contests. If it is a question of translation, that could be easily done, and text could be reused for future contests. If it is a matter of taxes, your sponsors (Sears in this case) could take care of this. If it's a matter of filling a form, it can't be that hard. Obviously there are contests in Quebec, there are Sear stores in Quebec and there are Sears tools and appliances in my home which is in Quebec. If you need some local info let me know.

Ed, thanks very much for posting this text. I'm sure there's similar legal obfuscation behind the "exclusion" of our European, Asian, et al., colleagues. Seeing the "official" reasoning (including the silly disclaimer at the end) might possibly help folks understand that this isn't something "you" are doing.

I've entered the contest just for the fun of it because I know I can't win any off the prices as I live in the Netherlands ( over in Europe ). I've seen some comments that I can enter but can't win a prize so I am just curious where I would end in the listing. Better to be disqualified in the end and knowing where you would have been and not win a prize then not knowing where you could have been at all. Maybe this could be something for the rules in a next sweepstake, you can enter and compete for the standings but you can't win any off the prices, this makes it nicer for the out off the USA and Canada people to compete.
