Is hackintosh illegal if you have a legal copy of mac osx to install with?

Depends on who you ask. Technically, the Terms of Service will tell you that you must install on Mac products. On the other hand you "own" the software and hardware, and should be free to do what you want with it. To the best of my knowledge, there are no legal precedents. Likely, it's included in the Terms of Service so they can A.) get out of servicing products they didn't manufacture, and B.) to try and scare you into buying their product. As far as I know, nobody has ever run into legal problems with hackintosh.

Fair point. I still think it could be argued in court, however most individuals, and even most small companies would not have the resources available to take on such a legal battle, so Apple would pretty much win by default.

In using the software, you accept the License Agreement, which (as Yokozuna says) includes a requirement that you use the Mac operating system only on Apple products. That agreement is a contract, so in setting up a hackintosh you are violating the contract and are liable if they want to bring a civil lawsuit against you. The law is on their side.

Of course it probably isn't worth their trouble to come after you. On the other hand, you may be the person they pick to make an example of -- consider some of the ugly copyright violation cases that have come up in recent years.

just wondering if it is illegal, it seems like a popular controversy, i have not created a hackintosh
just hope apple doesnt come after me if they read this :)

For what it's worth, OSX is based on FreeBSD. Most of the operating system is open source.

Well I know that this is old and I will delete my comment if you ask but in respond to what yokozuna said if you read the Eula it actually says that you do not own the software but are licensed to do what you want with it as long as you do not violate any other terms set forth in the Eula and that by using the software you are agreeing to the Eula.
