Do instructables need disclaimers? Answered

I see a lot of instructables with disclaimers on them. If person A posts a dangerous project and person B is hurt trying it, could person B sue person A? In other words, are disclaimers necessary on this site when Instructables has its own terms of use?

Legally, no - the site's boilerplate already has the necessary disclaimers built in, with all responsibility for safety laid firmly at the door of whoever is wielding the tools.

Morally, most people feel better if they add disclaimers for non-obvious hazards.

If you read an Instructable that has a part about "jumping off a roof" (just made this up...)

If you choose to do it and get injured, It shouldn't be the authors fault that you chose to do it in the first place, while obviously knowing that it is dangerous...

If you cut yourself with a knife bought at a culinary store do you sue the store ?

If you cut yourself making a knife from an instructable project do you sue the auther ?

The second question in your comment is what I am trying to find out. I am not the type to sue others to make myself feel better about having done something stupid, but unfortunately a lot of people in our society are. So: CAN one person sue another based on an Instructable?

Any one can sue another, but at a first hearing most judges will throw out useless (stupid) frivolous suits.

"In law, frivolous litigation
is the practice of starting or carrying on lawsuits that, due to their
lack of legal merit, have little to no chance of being won."

If your seriously concerned start as a new member under a different user info page and country Greg.

Another thing you can do is search for the idea you want to present and see how others have handled the situation or do you believe no one has come up with the same idea.

thanks for the info! I haven't actually posted any 'ibles so it's not a situation I am in. I just see how many people post disclaimers at the beginning of their instructables and wonder why they see it as necessary.

I have this superb instructable that starts with "take an axe and cut off your head..."

Mmm we unfortunately live in a litigious world and sometimes I am surprised and sometimes concerned at what people do publish here and or other places on the Internet but in general the type of people who are going to "cut off their head because they saw it on the web aren't going to last long anyway.

Still it does no harm I guess to suggest cutting off you head is not such a good idea and only presented for educational purposes.
