In such a case, the dispute is submitted first to mediation underneath the WIPO Mediation Rules. Then, if a settlement just isn't reached within a defined time frame (it is suggested that the parties provide for either 60 or 90 days), or if a celebration refuses to participate or to proceed to take part in the mediation, the dispute is referred for a binding decision through arbitration under the WIPO Arbitration Rules (or, if the events so agree, through expedited arbitration).
